The War on Cartels: An evaluation of the Impact of Criminalisation on Deterrence and Compliance

Presenter Professor Christine Parker,
Monash Centre for Regulatory Studies, Faculty of Law, Monash University

Thursday 1 September 2011, 1:10pm, Law Staff Library, 2nd Floor Building 12

Cartel conduct is a crime. This presentation, however, reveals interview evidence suggesting that business people penalised for cartel activity do not see their own activities as criminal and punishable. These findings, along with quantitative survey evidence on the lack of knowledge of the law and fear of its criminal enforcement, have significant consequences for the integrity of the whole project of using criminal law for economic regulation.
